Object


These GTC govern the relationship between our company and customers who make purchases on our website irasshai.co(hereinafter referred to as the "Site"). They define the conditions of sale and the rights and obligations of the parties.


The present General Terms and Conditions of Sale are entered into between an individual or legal entity wishing to make a purchase for strictly personal use via the Site (hereinafter referred to as the "Customer") and the iRASSHAi sales outlet located at 40 rue du Louvre, 75001 Paris.

In accordance with the provisions of articles 1316 to 1316-4 of the French Civil Code, it is reminded that the validation of the order form as specified in Article 3 constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature.

The contract resulting from the Customer's actual order is subject to the regulations governing distance selling, as set out in the legislative and regulatory provisions in force in France, as well as the provisions set out below, which the Customer undertakes to accept in full when placing his/her order.

iRASSHAi reserves the right to modify the present General Terms and Conditions of Sale. The Customer will be informed of any new version of these Terms and Conditions on the Site, and is responsible for taking cognizance of it. The online version of these General Terms and Conditions of Sale on the Site shall prevail, where applicable, over any other version of the said General Terms and Conditions of Sale. iRASSHAi reserves the right to modify the General Terms and Conditions of Sale at any time.

 

Products and prices

iRASSHAi makes its best efforts to comply with the requirements of article L. 111-1 of the French Consumer Code by putting the essential characteristics of the Products online. The photographs of the Products are provided for illustrative purposes only and are not contractually binding. The Customer is invited to consult the description of each Product to find out its essential characteristics and composition. The indications, without being exhaustive, are mentioned mentioned on each product sheet and are intended to to inform the Customer as fully as possible about the essential characteristics of the products. Information appearing on packaging, and information communicated by manufacturers and suppliers, is subject to change at any time, sometimes without notice. These indications may be subject to minor variations, and therefore cannot replace the information appearing on the product packaging, which is the sole source of information, and to which the Customer is invited to refer, particularly in the event of food intolerance.

By placing an order for alcoholic beverages, the customer acknowledges that it is his/her responsibility to ensure that he/she is of legal age according to current legislation. Should the customer fail to comply with this requirement, iRASSHAi cannot be held responsible for any legal consequences and reserves the right to refuse the customer's order.

Prices are given in euros and include all applicable taxes. 

Prices are subject to the French Value Added Tax (VAT) applicable on the day of the order.

Delivery charges will be indicated when the order is placed and are payable by the customer.

 

Information on best-before dates (BBD/BBD)


The food products offered for sale on our site comply with strict quality and safety standards. We guarantee a Use By or Best Before date of at least 25 days from the order validation date.
Please note that a Use By date has no impact on the safety or nutritional quality of the products once the date has passed, and that they can still be consumed without risk to health.
Due to the simultaneous management of different batches, we are unable to communicate precise dates directly on our site.

 

1km in-store price guarantee 

We are committed to offering you the best prices in our grocery store located at 40 rue du Louvre. If you find an identical product at a lower price within a 1 km radius of our store, we will refund you the difference in the form of a voucher subject to the following conditions:

The purchase must have been made within the 7 days preceding your claim.
You must present the sales receipt or proof of purchase from our store.
You must provide proof of the price charged by the competition, clearly showing that the product is identical (same Vendor, model, quantity, etc.).

Excluded from this guarantee are products subject to any discounts (sales, flash sales, reduced prices, resale, etc.) and online purchases.

Workshops

SUBJECT:

The iRASSHAi company offers workshops and cooking courses dedicated to Japanese gastronomy, for both individuals and professionals. Details of the program, including formats, locations, dates, times and prices, are available on request from the following e-mail address: hello@irasshai.co and at https://irasshai.co/collections/ateliers.

The purchase of one or more courses implies unconditional acceptance of these terms and conditions on the day of registration. 

COURSE REGISTRATION :

Registration is made directly on the product page of the irasshai.co website for the workshop in question, subject to availability.

Course content, dates, timetables and prices are quoted on the basis of discussions with the customer. Acceptance of the quotation in writing implies acceptance of the general terms and conditions of sale attached to the quotation.

The customer warrants that he/she has the legal capacity to contract iRASSHAi's services.

Registration is confirmed by email once the checkout process has been finalized on irasshai.co. The customer must provide his/her e-mail address for confirmation and the information required for the course to run smoothly.

RATES AND PAYMENT TERMS :

Prices are indicated on the workshop's product page in euros or by quotation. Payment is by credit card.

It is possible to cancel your reservation for a workshop 4 days before the scheduled date. For cancellation requests received by iRASSHAi less than 4 days before the workshop date, iRASSHAi will consider the request on a case-by-case basis and reserves the right to refuse the cancellation request and the deposit will not be refunded. 

CANCELLATION AND MODIFICATION CONDITIONS :

Any change in the number of participants must be notified to iRASSHAi in writing at least five days before the course. No price reduction will be applied.

Any increase in the number of participants less than five days before the course is subject to iRASSHAi's agreement and will be subject to an additional individual fee, in accordance with the quote.

CANCELLATION BY iRASSHAi :

iRASSHAi reserves the right to cancel or postpone a course in the event of force majeure. No refunds will be made. In the event of cancellation, iRASSHAi will inform the customer as soon as possible and plan a new date with the same services. iRASSHAi reserves the right to postpone a course for 8 people if the number of participants is less than 5. 

iRASSHAi reserves the right to modify or cancel recipes, dates, class times or locations in the event of circumstances such as the failure of the instructor or supply difficulties. In such situations, the customer acknowledges that adjustments may be made to the recipes initially planned, depending on product availability. If these adjustments do not fundamentally alter the recipe or its essence, the course will be maintained, and no partial or total refund will be made. The customer will be informed of such adjustments by e-mail or telephone as soon as possible.

RESPONSIBILITY :

Participants are responsible for their own active participation and for complying with health and safety regulations. iRASSHAi is not liable for any personal injury sustained during the course.

The customer must report any allergies; otherwise iRASSHAi cannot be held responsible.

For workshops involving the preparation or tasting of alcoholic beverages, iRASSHAi reserves the right to verify the age of participants. The customer undertakes to inform iRASSHAi of his or her status as an adult before the start of the workshop. iRASSHAi declines all responsibility in the event of non-disclosure of the customer's age. By participating in a workshop including alcoholic beverages, the customer acknowledges that it is his/her responsibility to ensure that he/she is of legal age according to current legislation. In the event of failure to comply with this requirement, iRASSHAi cannot be held responsible for any legal consequences that may arise, and reserves the right to refuse the customer's participation in the workshop without any refund.

Participants are responsible for their own personal belongings. iRASSHAi cannot be held liable for any damage or loss.

Participants have the option of taking dishes prepared during the course away from iRASSHAi for consumption. iRASSHAi would like to draw your attention to the fact that dishes must be kept in a cool place and consumed within the day. The customer is solely and exclusively responsible for the consequences of transport, storage and any resulting damage.

 

CONFIDENTIALITY AND PERSONAL DATA :

Data collected during courses may be used by iRASSHAi for reservation management, customer follow-up, statistics, surveys, and the sending of personalized offers with the customer's consent. The customer may object to this sharing by writing to hello@irasshai.co.

The customer has the right of access, rectification, deletion and opposition by writing to hello@irasshai.co.

The customer must inform iRASSHAi if he/she does not wish to appear in potential photos taken during a workshop.

DISPUTE RESOLUTION :

The present conditions are governed by French law. Any complaint may be addressed to hello@irasshai.co. Any dispute arising out of or in connection with these terms and conditions shall be referred to the Tribunal de Commerce de Paris.


Loyalty program

Introducing the iRASSHAi loyalty program

Club iRASSHAiClub, our loyalty program, is designed to reward our customers for their purchases and loyalty. By accumulating points, customers can exchange them for gifts, discounts and other exclusive offers.

Membership conditions: Anyone can join Club iRASSHAi free of charge. To join, simply go to our dedicated page and create an account.

Accumulating and using points

Points accumulation :

  • For every euro spent on our site irasshai.coin the grocery store or at the takeaway counter at 40 rue du Louvre in Paris, the customer earns 5 points.

  • When customers eat at KISSATEN, SAKABA, SHOKUDO or BIWAN, they must upload their receipt to our dedicated page.

Points credit : Points are credited to the customer's account as soon as possible after a purchase or the completion of a mission. Points cannot be transferred or exchanged for cash.

Missions : Customers can also accumulate points by completing various missions (newsletter registration, product reviews, photo sharing, etc.), available for consultation on our dedicated page.

Using points :

  • All available rewards (gifts, discounts, invitations, exclusives) are listed on our our dedicated page.

  • Customers can redeem their loyalty points for a reward autonomously from their personal space or at the grocery store checkout at 40 rue du Louvre, 75001 Paris.

  • Loyalty points have no expiration date and can be used at any time.

  • The expiry date of rewards is specified when redeeming points for them, and communicated by email and on the platform.

Consulting points : Customers can consult their points balance at any time from their personal space by logging on to our website.

Program modification and termination

iRASSHAi reserves the right to modify the conditions of the loyalty program. Customers will be informed of changes via the usual means of communication (email, website).

iRASSHAi reserves the right to modify the conditions under which the customer may terminate the program and to terminate a customer's membership at any time.

Personal data protection

Personal information collected as part of the loyalty program is used exclusively to manage the program and will not be shared with third parties without the customer's explicit consent, in accordance with our privacy policy.

Liability

iRASSHAi cannot be held responsible for any inconvenience or damage related to the loyalty program, except in the case of gross negligence.

In the event of force majeure or unforeseen events affecting the program, iRASSHAi cannot be held responsible.

Control

Any Order implies consultation and acceptance of the GTS.

To place an order on the Site, the Customer must :

  • Be of legal age to order alcohol
  • Legal capacity to contract
  • Have an address in one of the delivered countries
  • Have a bank account with sufficient funds to pay for the order online.

 

The customer places an order by following the ordering process indicated on our Site. Before confirming the order, the customer must check the details of the order, including the products selected, quantities, prices and delivery charges. Once the order has been confirmed, our company will send an order confirmation by e-mail to the customer.


Payment


Payment for products and delivery charges must be made by credit card or any other means of payment available on our website. Payment must be made at the time the order is placed.


The order for Product(s) will only be considered firm and definitive once it has been confirmed by iRASSHAi. Once the Product(s) order has been confirmed and payment validated, a printable and saveable summary of the Customer's order is displayed, mentioning the order references.

In the event of refusal by the bank, the order will be automatically cancelled and the Customer informed by iRASSHAi.

iRASSHAi uses a payment service provider and therefore never has access to confidential information relating to the Customer's means of payment.


Delivery

The Products will be delivered to the postal address given by the Customer at the time of ordering and shown on the delivery note. The Customer will be able to follow the progress of the delivery via a hypertext link provided with the shipment confirmation.

Estimated delivery times are communicated to the customer when the order is placed. iRASSHAi undertakes to make every effort to respect these times. However, unforeseen circumstances, such as delays beyond our or the carrier's control, may have an impact on these times.

Specific areas and logistical constraints
iRASSHAi reserves the right to cancel and reimburse any order whose delivery proves impossible or particularly costly due to logistical constraints, particularly in areas that are difficult to access (islands, mountainous areas, Corsica, etc.) or for bulky or heavy orders not accepted by carriers. In such cases, the customer will be informed as soon as possible and reimbursed in full.

Customer responsibility and re-invoicing of delivery costs
The Customer undertakes to provide accurate and complete information concerning his delivery address and contact details. iRASSHAi declines all responsibility in the event of late or failed delivery resulting from errors attributable to the Customer (incorrect address, absence at time of delivery, failure to collect the parcel from a relay point, etc.).

  • If delivery fails due to the Customer's fault, iRASSHAi will retain the amount of the delivery charges and refund the products only.
  • If a new shipment is necessary after a parcel has been returned to the warehouse for reasons attributable to the Customer, the cost of reshipment will be borne by the Customer and must be paid before any new shipment.
  • In case of return of a parcel not collected in a relay point or post office within the time limit, the shipping costs will not be reimbursed.

Receipt and inspection of the package
The customer must check the condition of the package on receipt. In the event of any anomaly (damaged, open parcel, etc.), he/she must express precise written reservations to the carrier and refuse the parcel if necessary. Failing this, iRASSHAi will not be able to take any subsequent claim into account.



Right of withdrawal and return

 

The Customer acknowledges that iRASSHAi distributes foodstuffs with a use-by date (DLUO) and perishable foodstuffs with a use-by date (DLC).

In accordance with article L. 221-18 of the French Consumer Code, perishable foodstuffs are not subject to the right of withdrawal.

 

Non-perishable products and returns
Non-perishable items (crockery, books, objects, textiles) can be returned to the iRASSHAi boutique (40 rue du Louvre, Paris 1er) or by carrier.

  • The customer is fully responsible for return shipping costs.
  • In the event of the return of an order for which the Customer is at fault (change of mind, order error, absence on delivery), iRASSHAi reserves the right to deduct from the refund the initial shipping costs as well as any return shipping costs incurred.

The exercise of the right of return is subject to the following conditions: products must be returned in their original condition and packaging, accompanied by their accessories and proof of purchase. Any damaged or altered product may be refused.

 

Warranty 


All products sold on our website are subject to a 2-year legal warranty.


iRASSHAi guarantees respectively that the Products conform to their intended use, and are free from defects or latent faults rendering them dangerous or unfit for normal use. Thus, all products on sale on the Site benefit from the legal guarantee of conformity (as defined in articles L217-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (as defined in articles 1641 et seq. of the French Civil Code), enabling the Customer to return defective or non-compliant products free of charge. iRASSHAi undertakes to ensure that its Products are at least 4 weeks before the sell-by date.



Liability


Our company cannot be held responsible for direct or indirect damage caused by the use of its products.

iRASSHAi may not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, the occurrence of bugs, external intrusion or the presence of computer viruses.



Intellectual property


All elements on our website, such as texts, images and videos, are the exclusive property of our company. Any unauthorized use of these elements is prohibited.

The Site is the full and complete property ofiRASSHAi. The latter is the owner of the intellectual property rights necessary to put them online.

Both the general structure of the Site (graphic charter) and its content (texts, slogans, graphics, images, sounds, videos), including software, databases and newsletters are the property ofiRASSHAi or third parties authorized to use them, and are protected by copyright. These do not grant any license or right other than that of consulting the Site. Reproduction of all or part of the Site and its Content is authorized solely for information purposes and for personal and private use.

Consequently, in accordance with the provisions of the French Intellectual Property Code, any representation, reproduction, modification, distortion and/or alteration of the Content, by any process whatsoever and on any medium whatsoever, without the express prior authorization of d'iRASSHAiis prohibited and constitutes an act of copyright infringement.

Similarly, any unauthorized use of the Site and/or its Content will render the User criminally and civilly liable on the grounds of copyright infringement.


iRASSHAi shall not be held liable for any hypertext links within the Site to other sites, or in general to any existing resources on the Internet.iRASSHAi.

Any creation of links to the Site, any framing of the Site, and more generally any use of the Content, is subject to the prior and express authorization ofiRASSHAi which may be revoked at any time at its sole discretion. iRASSHAi reserves the right to request the removal of any link to the Site that has not been, or is no longer, authorized, and to claim damages for any loss suffered as a result.



Personal data

Our company collects personal data when ordering and shipping products. This data is processed in accordance with our privacy policy, which is available on our website.


iRASSHAi ensures that your data is kept confidential and attaches great importance to the protection of personal data. Personal data is collected when you place an order and is essential for order processing.

It will be used by iRASSHAi in order to ensure order follow-up and customer relations, organize delivery, communicate with logistics service providers, and send solicitations concerning products offered by iRASSHAi if you have given your consent.

The company iRASSHAi reserves the right to contact the customer by e-mail or telephone if the customer has purchased a product affected by a supplier recall for major safety or health reasons.

In accordance with the regulations in force and in particular the European Data Protection Regulation, any person has the right to access, rectify and oppose/delete personal data concerning him or her, by writing to by email to the address : privacy@irasshai.co


iRASSHAi undertakes to implement all necessary and appropriate technical and organizational measures to protect said data.

We keep your data for the duration of our commercial relationship and in any case for the time necessary for the purpose of processing.

In addition to the retention period, your data will no longer be used to send you commercial solicitations via email and or sms beyond a period of three years from your last interaction with us, i.e. either :

- Your last order on our platform or purchase in our store;

- Your last communication with customer service.

 

Force majeure


Neither the Customer nor iRASSHAi can be held responsible for the total or partial non-fulfilment of their obligations, if this non-fulfilment is due to an act of God or force majeure which hinders or delays their execution. This includes, but is not limited to, war, riots, insurrection, social unrest, strikes of any kind, flood, fire, storm, shortage of raw materials, lock-out, hospitalization (particularly for the Customer), pandemic and epidemic, mandatory government or administrative decisions ordering the closure of shops and deliveries, these various elements being assessed in relation to applicable case law.

iRASSHAi will inform the Customer of any such fortuitous event or force majeure within 7 (seven) days of its occurrence.

The party affected by such events shall inform the other party as soon as possible and at the latest within five (5) working days of the occurrence of the event.

In such a case, the Customer and iRASSHAi agree to consult each other as soon as possible in order to determine together how the order will be carried out for the duration of the force majeure event.

 

Final Stipulations

Partial invalidity

If one or more stipulations of the GTC are held to be invalid or declared as such in application of a law, regulation or following a final decision of a competent court, the other stipulations will retain all their force and scope.

Entire contract

The GCS and the order summary sent to the Buyer form a contractual whole and constitute the entire contractual relationship between the Parties. In the event of contradiction between these documents, the GCS shall prevail.

No waiver

The fact that one of the Parties does not avail itself of one of the stipulations of the GCS shall not be considered or interpreted as a waiver of its benefit.

Translation

Translated versions of legal texts and policies are provided solely as a convenience to facilitate reading and understanding of the French versions. In providing these translations, the aim is not to arrive at a legally binding agreement, nor to substitute the legal validity of the French versions. In the event of any dispute or conflict, the French versions of legal agreements and policies govern our relationship and will prevail over any terms and conditions set forth in any other language.
